Driver Agreement & Release of Liability

Version 2026-06-14 · This Agreement is between you ("Driver") and Job Site Run LLC, a Montana limited liability company ("Job Site Run," "we," or "us"). You accept it when you register as a driver. It works together with the Terms of Service; where this Agreement is more specific about driving, this Agreement controls.

By accepting, you confirm you have read and agree to be legally bound by this Agreement, including the release and indemnification below. If you do not agree, do not register or accept loads.

1. Independent contractor

You are an independent contractor operating your own hauling business. You are not an employee, agent, partner, or joint venturer of Job Site Run. You control your own vehicle, hours, routes, methods, and which jobs you accept or decline. Nothing in this Agreement creates an employment relationship. You are solely responsible for your own federal, state, and local taxes, including self-employment tax.

2. Your vehicle, licensing, and insurance

You represent and warrant that, at all times while using the platform, you: (a) hold a valid driver's license; (b) own or are authorized to operate the vehicle(s) you use; (c) maintain the vehicle in safe, legal, roadworthy condition; and (d) carry valid insurance adequate for your operations, including any commercial or business-use coverage required for transporting goods for compensation.

Job Site Run does not provide, and is not responsible for providing, any vehicle, auto liability, commercial, cargo, medical, disability, workers' compensation, or other insurance for you. You understand that personal auto policies commonly exclude driving for pay, and that obtaining appropriate coverage is your sole responsibility.

3. Assumption of risk

You understand that operating a vehicle and loading, securing, transporting, and unloading cargo involve inherent and significant risks, including risk of property damage, bodily injury, or death to you or others. You knowingly and voluntarily assume all such risks arising from your use of the platform and your performance of any job.

4. Release of liability

To the maximum extent permitted by law, you hereby release, waive, and forever discharge Job Site Run LLC, its owners, members, managers, officers, employees, contractors, and agents (collectively, the "Released Parties") from any and all claims, demands, damages, losses, liabilities, costs, and expenses of any kind — whether known or unknown, arising in contract, tort, or otherwise — that arise out of or relate to: your operation of any vehicle; the condition of your vehicle; your loading, securement, transport, or unloading of any cargo; any injury to you or damage to your property; your interactions with customers or third parties; your tax, licensing, or regulatory obligations; or your use of the platform.

This release does not apply to the extent a loss is finally determined by a court of competent jurisdiction to have been caused by the Released Parties' own gross negligence or willful misconduct, and only to the extent such a limitation on release cannot be waived under applicable law.

5. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all third-party claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your transportation services; your operation or condition of any vehicle; bodily injury, death, or property damage you cause or contribute to; cargo loss or damage; your violation of any law or of these terms; your negligence or willful misconduct; or your status or obligations as an independent contractor (including tax and insurance obligations).

This obligation survives the termination of your account and your use of the platform. We may, at your expense, assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate.

6. Licensing, permits, and regulatory compliance

You are solely responsible for determining and obtaining any business license, permit, or registration your city, county, or state requires for the work you perform, including any requirements that apply to in-home services. You are responsible for your status under Montana independent-contractor law, which may require an Independent Contractor Exemption Certificate (ICEC) or workers' compensation coverage. You are responsible for any federal or state transportation (including USDOT/MC/CDL) requirements that apply to the loads, weights, and routes you choose. You acknowledge that Job Site Run does not obtain these for you, does not verify them, and is not responsible for your compliance. You also acknowledge that Job Site Run verifies your identity but does not perform a criminal-history or driving-record background check, and that any representation you make about your insurance is your attestation, which Job Site Run does not independently verify.

6a. Delivery location — no entry into homes

You deliver to a safe, accessible point at the destination (curb, driveway, garage, doorway, threshold, dock, or designated drop area). You are not required or expected to enter a customer's home or other private interior space, and we recommend you do not. Threshold delivery is the standard. If a customer asks you to bring items inside, you may decline for any reason; if you choose to do so, you do it as your own independent business decision and at your own risk, and you agree the Released Parties have no liability arising from entering, or declining to enter, any property. You will not provide in-home moving, assembly, or installation as part of a platform job.

7. Safety and conduct

You agree to operate safely and lawfully; to obey all traffic, vehicle, weight, and transportation laws; to refuse loads that exceed your vehicle's legal or rated capacity; to decline prohibited or hazardous items; and to take the load and proof-of-delivery photos the platform requests.

8. Payment

You are paid the driver's share shown for each job (your payout is displayed before you accept), via our third-party payments processor, after the delivery is confirmed. You are responsible for maintaining an accurate payout account and for taxes on your earnings.

9. Termination

You may stop using the platform at any time. We may suspend or terminate your access for violations of this Agreement or the Terms, safety concerns, fraud, or legal requirement. Sections 1–5 and 10 survive termination.

10. Governing law and disputes

This Agreement is governed by the laws of the State of Montana. Disputes are resolved as set out in the Terms of Service, including binding individual arbitration and the class-action waiver, seated in Missoula County, Montana.
